How To Find a Good Web3 Lawyer

It is important to find an experienced lawyer in the web3 space. The field is characterized by complex legal and technical issues that require specialized knowledge and expertise to navigate.

Several key reasons to make sure this isn’t your lawyer’s first web3 rodeo include:

#1: Evolving regulations: The web3 space is still relatively new, and the legal and regulatory landscape is rapidly changing. An experienced lawyer will be able to provide guidance and advice on how to comply with the relevant laws and regulations.

#2: Complex technology: Blockchain technology and digital assets are complex and technical, and it is important to have a lawyer who has a deep understanding of these issues to effectively advise you on your legal rights and obligations.

#3: Protecting assets: Digital assets and blockchain technology have the potential to revolutionize the way we store and transfer value, but there are also risks involved. Understanding and mitigating risks to protect your assets is an important component to consider in the web3 space.

#4: Resolving disputes: Disputes in the web3 space can arise from a range of issues, including contract disputes, hacking and theft, and regulatory violations. Having a lawyer with the knowledge and expertise to help you resolve these disputes effectively is valuable.

So how do you find such a lawyer?

What questions can you ask during the interview process?

What resources can you use to help narrow down the field of qualified candidates?

Three Steps

Consider one or more of these three steps:

#1: Ask a trusted friend or established company: Reaching out to others for the names of lawyers they know or have used in the past is a great way to find a good lawyer. If you don’t know anyone who might provide you with a recommendation, consider reaching out to 5–10 of the top web3 companies in your space and ask them who their legal counsel is. Reach out directly to that lawyer or firm and have a conversation to see if they are a good fit for your legal needs.

#2: Use Martindale-Hubbell: You can compliment the above by looking for a web3 lawyer on the Martindale-Hubbell website. This company has been evaluating attorneys for their strong legal ability and high ethical standards through a Peer Review Rating system. Use the filter system to drill down and find a lawyer in your city and state who focuses on the type of legal matter you need help with. Consider limiting your search to AV rated lawyers (highest rating of ethics and ability by other lawyers and local judges).

#3: Contact the local Bar Association: To find a good lawyer in another state or country, in addition to using Marindale-Hubbell, you can also contact the local Bar Association and ask for the name of the current Bar Association President. Normally you don’t work your way up the chain of leadership in these organizations without being good at what you do and respected by your peers. Give that person’s firm a call and see if they can help. If not, ask who they would recommend in town.

Ask These Questions

When you do meet with a potential attorney, consider asking the following questions. Don’t be shy during the interview process. Remember that in the end, the lawyer you end up hiring is working for you and not the other way around.

#1: What experience do you have with blockchain technology and the legal issues surrounding it?

This question is important because blockchain technology and the web3 space are relatively new and complex, and therefore the lawyer should have a solid understanding and experience in dealing with the present and future legal issues surrounding it.

#2: Can you walk me through a few cases you’ve worked on that are related to blockchain and digital assets?

Getting a feel for the lawyer’s practical experience in handling issues and cases that are relevant to your needs is important. Doing so helps you to gauge their understanding of the current legal landscape and how they may approach similar issues in the future.

#3: How do you stay current with the rapidly changing legal landscape in the web3 space?

This question is important because the web3 space is rapidly evolving, and it is essential for a lawyer to stay up-to-date on the latest developments and regulations in the field. This will ensure that they are providing you with the most relevant and current advice.

#4: Can you provide me with a list of 3–5 past or existing clients who I can reach out to independently hear about their experiences with your firm? Most confident and experienced lawyers will have a list of past clients they have been given permission to share with new prospective clients for this very reason. This last step isn’t a deal breaker but I suggest that you ask for this information because it can help make the final decision making process easier.
